This Privacy Policy applies to the collection, use and disclosure of information we receive from users, consumers and visitors (collectively “users” or “you”) to our website NUG.com and NUG retail stores. By using this website and visiting and/or shopping at our retail stores (collectively, the “Services”), you agree to the collection and use of information, including your personal information, in accordance with terms and conditions of our Privacy Policy. 

This Privacy Policy applies to information collected by NUG through our Services and does not apply to information collected by any third party sites to which the Services may link or to information provided to, or collected by, third parties through third party cookies or other technologies on our website or at our retail stores.

Where we rely on your consent to process your personal information, you can withdraw such consent at any time as described in the “Rights to Opt-In / Opt-out” section of this Privacy Policy.

Personal Information Collection And Use

While using our website, we may ask you to provide us with certain personally identifiable information that can be used to contact or identify you. Personally identifiable information may include, but is not limited to your name and email address (“Personal Information”).

We do not sell your Personal Information to any third party.

We use your Personal Information to improve our website and for other everyday business purposes including the marketing, advertising and promotion of NUG products. We may use your Personal Information to contact you with newsletters, marketing or promotional materials and other information that you have subscribed to.

Through contracts with affiliated companies and partners, NUG operates licensed cannabis dispensaries in California, including NUG in Sacramento and NUG Wellness in San Leandro (hereinafter “NUG Store” or “NUG Stores”).

When you visit or shop at our retail stores, in accordance with California law, we verify your identity and date of birth.

 

We examine and electronically scan your government-issued identification card. Once the data is scanned, your name, address, identification number, photo and gender are  retained. We record the amount and history of users’ purchases.

 

We also request that you provide your email address and/or phone number. Users that provide their email address and/or phone number expressly consent to receive from NUG email and/or text messages. Users may unsubscribe or opt out of receiving NUG email and/or text messages at their choice. We also record the history of users purchases.

 

We retain and use the Personal Information provided to us at our retail stores for everyday business purposes including to verify your age, identify your location, provide you information on discounts, promotions, new products, store events, and assist in the marketing, advertising and promotion of our stores and NUG products.

 

We may share Personal Information with companies affiliated with NUG. We may use third parties for the gathering, storage, and analysis of Personal Information. We may share Personal Information with third parties in the marketing, advertising and promotion of NUG Services and products. We may also release your Personal Information if required to do so by law, or in the good faith belief that such action is necessary to comply with a court order, regulatory request or state law.

Security Cameras

Inside and around NUG Stores, we deploy digital video security cameras that capture the images of users and their vehicles to assist in the secure and safe operations of NUG Stores and in compliance with state and local laws. The digital video files are retained by NUG and may be accessed and used by NUG employees and public agencies at any time for any business or law enforcement purpose.

Retention Period

NUG is obligated under state law and regulations governing licensed cannabis businesses to retain for a period of at least seven years records applicable to commercial cannabis activity including data from or associated with users including sales invoices and receipts.

California Privacy Rights

This section of our Privacy Policy constitutes a PRIVACY NOTICE FOR CALIFORNIA RESIDENTS and supplements the information contained herein and applies solely to users and consumers who reside in the State of California. We adopt this notice to comply with the California Consumer Privacy Act of 2018 (“CCPA”) and other California privacy laws. Any terms defined in the CCPA have the same meaning when used in this notice.
